C.H. Robinson Loses $604 Million Bid to Overturn Nuclear Verdict
C.H. Robinson has landed itself in hot water in recent months with a number of scandals. A verdict of $604 million was ruled to be paid out to those affected by the semi-truck accident that led to three people killed in 2021.The troubled broker tried to overturn this nuclear verdict.
During a court hearing in Texas, Judge Dianne Jones ruled to uphold a $604 million nuclear verdict against the Eden Prairie-based company. Not only did she rule to uphold the verdict, but she said that interest would be applied for every day that it went unpaid. As of right now, that verdict has reached $700 million with interest.
What’s the Reason for the $604 Million Nuclear Verdict?
Back in 2021, there was a fatal accident caused a six-car pileup in Jackson, Mississippi, and took the lives of three individuals. This included the company driver for the carrier Lupus Superior known as Gorgonio Gonzalez.
Because the company driver died in the accident, it made it difficult for them to know exactly what had happened. However, some evidence suggests that before the accident happened, the driver sent a message to the broker saying he felt ill and unsafe to drive.
They determined that because the driver operated under the control of the broker, he was an employee for that shipment. This led to them being responsible under vicarious liability.
Verdicts like this are why carrier vetting stopped being a back-office formality. The $604 million was one element, but they also had to pay interest of $107 million, which is about 6.75% interest.
The company has vowed to continue fighting the verdict, but let’s say that they would choose to appeal the verdict further. If they choose to appeal further, it would mean that they will be subject to more interest if it fails.
This Case Follows at the Heels of the Montgomery v. Caribe Ruling
Under this ruling, it was determined that if a broker was seen as acting negligently when vetting carriers, they could face lawsuits for negligence and crashes that the carriers caused. This shows you one of the reasons that this trouble company has faced a slew of lawsuits recently. Before, people were wondering why freight brokers were able to get off scott-free from these accidents, despite the fact that they should have vetted the drivers better. It stems from an issue with people using dangerous chameleon carriers.
Sympathy Shown for the Victims in Statement
The broker would say that it felt truly sorry for the victims who lost their lives in this accident. However, they would continue in saying that they had nothing to do with the accident, and they must continue to look at both the facts and what the law says.
Dorothy Capers, the spokeswoman for the company, would start by saying what constitutes a hiring process that would protect them from this sort of nuclear liability? It hasn't been defined, she argues.
Capers would continue by saying that this verdict is the reason we need to set a clear national standard on what it means to be a safe carrier. She would continue by saying that America and its network of freight shouldn’t be subject to safety standards determined after the accident took place.
Publicly Traded Company Sinks to Its Lowest
After this verdict, the company’s stock (CHRW) would go on to sink to its lowest point in the last year. There is a risk that if they choose to continue fighting against the verdict, they could wind up paying even more interest, adding further to the risk of fighting it. When the court looked at the responsibility for this case, they found that the driver was 45% responsible, Lupus Superior 32% responsible, and CHRW was 23% responsible.
The recent court judgment leaves that number unchanged. Under the new judgment, CHRW would be answerable for 68% of the case, 23% directly and 45% vicariously.
